1. The included license
Unless separately agreed in writing, delivered media comes with a non-exclusive commercial license to market the specific photographed property, for the commissioning client, across: atHome and other property portals; the agency's website; the agency's social media; and property-marketing brochures.
Normal sharing with the property owner, portals and service providers strictly for marketing that property is permitted and will not be unreasonably restricted.
2. What remains with FORMA31
To the extent legally applicable, copyright and authors' rights in the delivered media remain with FORMA31 (or its photographers/creators). The license above grants usage rights; it is not a transfer of copyright unless expressly agreed in writing.
3. Uses that need separate permission
The following are outside the included license and require FORMA31's separate written permission: resale or sublicensing of the media; stock-media licensing; advertising unrelated to the marketing of the photographed property; transfer to unrelated third parties for their own use; and materially different commercial uses.
4. FORMA31's portfolio use
FORMA31 does not assume an automatic right to publicly showcase every private residence. Portfolio/self-promotional use of project media is arranged as follows: where required by the nature of the property or applicable rights, FORMA31 will seek permission (via the service confirmation or a specific request) before publishing identifiable project media in its portfolio or social channels; clients may decline or limit portfolio use of their projects, and may withdraw permission for future use at any time with reasonable effect.
⚖ This clause requires verification by a Luxembourg lawyer before launch and before adoption in binding contracts. The portfolio-permission mechanism in service confirmations should be finalized with counsel.
5. People and privacy in property media
Shoots are planned to avoid intentionally capturing identifiable occupants or sensitive personal material unless needed and authorized. The client ensures the property is appropriately prepared (see the General Service Terms). Where identifiable persons are intentionally featured in marketing content, appropriate permissions may be required before use.
Where reasonable professional care was used, FORMA31 is not responsible for private documents or items left openly visible by the client/occupants, without prejudice to obligations under applicable law.
6. Floor plans — scope of reliability
2D schematic floor plans are marketing/reference material generated from the supported capture workflow. They are NOT an architect's plan, a cadastral plan, a building survey or an engineering document, and are not guaranteed for construction, legal-boundary or other technical purposes. Measurements and layout are approximate unless expressly certified through a separate qualified service. Survey-grade accuracy is not claimed.
