General Service Terms

Business registration is being prepared. This information is provisional: the operator’s identity, business address and registration details must be completed before the service terms are finalised.
1. Operator and scope
FORMA31 is a real-estate media project in Luxembourg. Business registration has not yet been completed. The operator’s legal name, business address, legal form and applicable registration, authorisation and VAT details have not yet been supplied for publication. This information remains provisional until those details are completed.

These terms describe FORMA31’s intended professional/B2B service framework for photography, drone imagery, property films, social content, Matterport tours and schematic floor plans. They do not establish that business registration or any required authorisation has been obtained. Mandatory rights remain applicable in all cases.
2. Requests and acceptance
Submitting the website form is not an automatic acceptance of a booking by FORMA31. An appointment remains pending until FORMA31 confirms availability and the proposed scope separately. No payment or cancellation charge arises merely from submitting the form.
An assignment is agreed when the client accepts a written Job Confirmation, quotation or order confirmation referring to the applicable terms. The property, services, price, appointment and any special conditions must be provided before acceptance. Expressly agreed special conditions take precedence for that assignment. Later website updates do not change the terms already accepted for an earlier job.
3. Pricing and travel
The configurator gives the expected service price for a standard residential property accurately described. Properties above 300 m² receive an individual quotation. A material change in surface, access, scope or feasibility may require a revised proposal; additional charges require the client’s agreement before the work proceeds.
The current configurator adds no VAT. The final VAT status and legally required wording will be confirmed following business registration and stated in the written proposal before acceptance. The current display is not a claim to a particular tax exemption.
The existing B2B service framework includes travel within a 30 km radius of Luxembourg City unless otherwise stated. Any supplement beyond that radius must be disclosed and accepted before confirmation; it is not added after the visit without prior agreement.
4. Access and property preparation
The client must have authority to commission the work, arrange lawful access at the agreed time, inform occupants and provide accurate property information. Relevant restrictions, safety concerns and third-party rights must be disclosed beforehand.
Cleaning, decluttering, staging, repairs and moving substantial furniture are not included unless agreed separately. The client should put away private documents, valuables and personal items. Minor adjustments for composition do not constitute a cleaning or staging service.
5. Creative work and revisions
Composition, image selection, colour treatment, music, sequencing and editing are professional creative decisions within the agreed scope. AI-assisted tools may support appropriate creative and editing tasks, but must not intentionally misrepresent the property.
Photography includes reasonable correction of technical issues attributable to FORMA31. A Reel or cinematic film includes one minor revision round. Requests should normally be made within 7 calendar days of delivery. A new concept, substantial restructuring or new filming requires a separate agreement; mandatory rights are unaffected.
6. Delivery and file availability
The quote states the expected delivery windows: photos from the next business day; social content within 2 business days; cinematic film within 2–3 business days; Matterport and floor plans within 2 business days. These are targets subject to access, scope and circumstances beyond reasonable control.
Online delivery links normally remain available for one calendar month from actual delivery. Download and keep your own copies. After that period, long-term retention, restoration and repeat delivery are not guaranteed. A USB copy is included for an assignment containing a Reel or cinematic film unless otherwise agreed; physical USB delivery does not delay the effective date of online delivery.
7. Payment
The accepted written confirmation determines the amount due. Unless otherwise agreed, invoices are payable by bank transfer within 14 calendar days of the invoice date using the details on the invoice. This website does not collect online payments.
Statutory commercial late-payment interest and recovery compensation may apply where Luxembourg law provides for them in a B2B transaction. No additional rate is created by the website configurator.
8. Related policies and rights
The cancellation, drone and weather, Matterport hosting and usage/licensing policies explain those parts of the service. They apply to an assignment when included in its accepted terms. Copyright remains with its rights holder; the client receives the agreed licence for marketing the relevant property.
9. Responsibility, complaints and unexpected events
FORMA31 provides media-production services and does not guarantee a sale, rental, price, number of enquiries, ranking, views or marketing result. Platform availability and weather conditions cannot be guaranteed. FORMA31 remains responsible for exercising reasonable professional care.
Report material problems promptly so that correctable technical defects can be addressed. If an additional capture is needed solely because of an issue attributable to FORMA31 within the original scope, no additional production fee is charged for it.
Responsibility for loss or damage is determined under applicable law and any valid terms expressly agreed for the assignment. Nothing here excludes liability that cannot lawfully be excluded. Events beyond reasonable control will be discussed promptly to arrange an appropriate adjustment or rescheduling; they do not automatically extinguish statutory rights.
10. Governing law and disputes
Luxembourg law applies, subject to mandatory rules. The competent courts are determined by applicable law and any valid jurisdiction agreement accepted for a professional assignment. Nothing in these pages removes mandatory consumer rights where they apply. Contact FORMA31 first to discuss a possible resolution.
